RE: Implementation of local competition in the territories of Sogetel Inc., Téléphone Milot Inc., Téléphone Guèvremont Inc., and CoopTel - Request by Cogeco for a new proceeding

On 27 August 2012, Cogeco Cable Inc. (Cogeco) filed its comments following the Commission’s 25 July 2012 letter requiring that Téléphone Guèvremont Inc., Téléphone Milot Inc., Sogetel Inc., and CoopTel (collectively, the small incumbent local exchange carriers [small ILECs]) provide the completion dates they and Cogeco/TELUS Communications Company (TCC) had mutually agreed on for each step in the implementation of local competition.

In its comments, Cogeco requests that the Commission initiate a new proceeding to enforce, for each of the small ILECs, the establishment of an interconnection arrangement based on leased circuits for each local interconnection region involved, unless it is demonstrated that such an interconnection entails more disadvantages than advantages, or that a negotiated interconnection agreement between the parties has been reached.

The Commission notes that TCC and the small ILECs are in negotiations to reach an interconnection agreement.  The Commission considers that, as indicated by the small ILECs in their comments of 28 August 2012, an intervention by the Commission, particularly in the form of a new proceeding, could lead to additional and undesirable delays in the implementation of local competition.

The Commission therefore denies Cogeco's request for a new proceeding.  The Commission expects parties to focus on the negotiations under way and to make every effort to conclude agreements as soon as possible.
