Re:  Tariff Notice 582 – Competitor Backbone Services

Dear Ms. Duguay:

On 28 August 2012, the Commission received an application by TELUS Communication Company (TCC) under Tariff Notice (TN) 582, in which the company proposed amendments to its CRTC 25082 Carrier Access Tariff, item 4.09, Competitor Backbone Services.

Under subparagraph 28(1)(a) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure, the Commission may require a party to provide information, particulars or documents that it considers necessary.

TCC is requested to provide comprehensive answers, including rationale and any supporting information, to the attached questions within 5 business days of the date of this letter.  Consequently, the application and any subsequent amendments will not be approved provisionally on the 15th calendar day following receipt.  However, the Commission intends to dispose of this application, along with any subsequent revisions, within 45 business days following receipt.

TCC TN 582 Interrogatory

In Telecom Decision 2006-9, the Commission approved proposals for the use of deferral account funds by incumbent local exchange carriers (ILECs) for the expansion of broadband services to communities in rural and remote areas.  The Commission also directed the ILECs to make available, at a minimal rate, the backbone facilities funded through the deferral accounts.

In its application, TCC proposed adding the names of the municipalities in which the work to build the backbone facilities has been completed.

Staff notes that in its annual report on the use of deferral account funds dated 2 April 2012, TCC indicated that broadband roll-out in the communities of Cap-des-Rosiers and Ristigouche-Partie-Sud-Est Cabinet in Quebec has been completed.

TCC must indicate the reason(s) for which those communities are not included in the list of municipalities that TCC proposes adding to its tariff.
