RE: Former TCI Tariff Notice 646 and TCBC Tariff Notice 4359 - Residential Rate Increases

On 14 August 2012 the Commission received applications by TELUS Communications Company (TCC), under TCI Tariff Notice 646 (TN 646) and TCBC Tariff Notice 4359
(TN 4359), in which the company proposed changes to TCI General Tariff item 425, Exchange Service, and TCBC General Tariff item 32, Exchange Rates.  TCC submitted that it was proposing to increase rates for residential service in high-cost serving areas (HCSAs) by accordance with the Commission’s determinations in Obligation to serve and other matters, Telecom Regulatory Policy 2011-291, 3 May 2011, as amended by Telecom Regulatory Policy CRTC 2011-291-1, 12 May 2011(TRP 2011-291).  The company indicated that its applications met the criteria for Group A applications, as defined by Approval processes for tariff applications and intercarrier agreements, Telecom Information Bulletin CRTC 2010-455, 5 July 2010 (Information Bulletin 2010-455).

Commission staff notes that paragraph 22(2) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (the Rules of Procedure) sets out the information that applicants must include in their applications and that paragraph 59 of the Rules of Procedure specifies the procedural requirements established for the approval of a tariff or an agreement.  Paragraph 8 of the Rules of Procedure provides that the Commission may return an application or close a file that does not meet these requirements.

TCBC TN 4359

Commission staff notes that although TN 4359 meets the criteria for a Group A application and has been forborne from approval, the revision numbers in the headers of the abridged and confidential versions of the tariff page have not been updated to reflect that the tariff page has changed.

Accordingly, the Commission requests that TCC issue a revised tariff page to correct the above-noted error.

Former TCI TN 646

Commission staff considers that TN 646 does not meet the definition of a Group A retail tariff filing as described in Bulletin 2010-455.  Staff notes that in paragraph 124 of TRP 2011-291, the Commission states the following:

To avoid exacerbating the rate differentials in HCSAs during the transition period, the Commission determines that rates that are already at $30 or more will not be permitted to increase further during that period.  These rates will be permitted to increase annually by the rate of inflation, effective 1 June 2014.

Staff notes, however, that TCC has proposed to increase the rate for sub-band F6, although the current monthly rate is already above $30.

Furthermore, staff notes that the revision numbers in the header of the confidential version of the proposed tariff page have not been updated to reflect that the tariff page has changed.

Because TCC’s application does not comply with the Commission’s requirements for tariff applications as described in Information Bulletin 2010-455, this file associated with former TCI TN 646 is closed.

TCC may submit a new application addressing the above-mentioned concerns.  The application must be presented in the form of a new Tariff Notice.
