RE: Status of implementation of local competition in the territory of Sogetel Inc.
In Telecom Decision CRTC 2012-42, Sogetel Inc. - Implementation of local competition for Cogeco Cable Inc. (Telecom Decision 2012-42), the Commission directed Sogetel Inc. (Sogetel) to provide information and assistance to Cogeco Câble Québec s.e.n.c.
(Cogeco Québec) and TELUS Communications Company (TCC) in the negotiation process, as required, in order to implement local competition as quickly as possible so that Cogeco Québec may begin operating in Sogetel’s territory by no later than 23 July 2012.
The Commission notes that on 22 June 2012, and again on 6 July 2012, Sogetel was requested to provide information with respect to the status of local competition implementation. The Commission notes that in the most recent response, mutually agreed upon completion dates between Sogetel and Cogeco Québec/TCC had not been provided for most milestones.
The Commission notes that the 23 July 2012 deadline has not been met, given that Cogeco Québec is still unable to offer its services in Sogetel’s territory, contrary to the Commission’s determinations in Telecom Decision 2012-42.
Accordingly, pursuant to paragraph 37(1)b) of the Telecommunications Act, Sogetel is required to resubmit the information requested in the table below indicating the completion dates mutually agreed upon by Sogetel and Cogeco Québec/TCC for each applicable milestone, by 20 August 2012.
Furthermore, the Commission notes that due to the fact that the deadline of 23 July 2012 set out in Telecom Decision 2012-42 has not been met, the Commission may, at any time, undertake further enforcement measures. Such enforcement measures may include registering Telecom Decision 2012-42 with the Federal Court, and/or a mandatory order proceeding against Sogetel.
