Dear Sir:
RE: Tariff Notice 35 - Rate Schedules for Primary Exchange (Local) Service
On 17 July 2012, the Commission received an application by Huron Telecommunications Co-Operative Limited (HuronTel), under Tariff Notice 35 (TN 35), in which the company proposed to increase rates for its primary exchange service. The company filed its application as a Group A tariff filing, with a proposed effective date of 1 June 2012.
Commission staff notes that paragraph 22(2) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (the Rules of Procedure) sets out the information that applicants must include in their applications and that paragraph 59 of the Rules of Procedure specifies the procedural requirements established for the approval of a tariff or an agreement. Paragraph 8 of the Rules of Procedure provides that the Commission may return an application or close a file that does not meet these requirements.
Commission staff notes that if HuronTel had filed the application on or before the proposed effective date of 1 June 2012, it could have filed it as a Group A application pursuant to Approval processes for tariff applications and intercarrier agreements, Telecom Information Bulletin CRTC 2010-455, 5 July 2010, as amended from time to time (Telecom Information Bulletin 2010-455). However, HuronTel did not file the application on or before the effective date. As a result, in addition to requesting approval of the proposed rates, the company must request ratification of rates charged otherwise than in accordance with an approved tariff since 1 June 2012. Commission staff also notes that pursuant to Telecom Information Bulletin 2010-455, HuronTel is required to file a request for ratification as a Group B application.
Because HuronTel’s application does not comply with the Commission requirements for tariff applications as described in Telecom Information Bulletin 2010-455, this file is closed.
HuronTel may submit a new application addressing the above-mentioned concerns. The application must be presented in the form of a new Tariff Notice.
Yours sincerely,
