RE: Cogeco Cable Inc. Part 1 Application regarding Quebec small ILECs granting themselves an undue preference

On 18 July 2012, Cogeco Cable Inc. (Cogeco) filed a Part 1 application with the Commission with respect to the implementation of local competition by Téléphone Guèvremont inc., Téléphone Milot inc., Sogetel inc, and CoopTel (the small ILECs).  In its application, Cogeco requested that a decision be rendered on an expedited basis.

In Telecom Decisions 2012-36, 2012-37, 2012-40, and 2012-42, the Commission set 23 July 2012 as the date by which local competition be implemented, therefore allowing Cogeco Câble Québec s.e.n.c. to begin operating in the small ILECs’ operating territories.

Commission staff considers that Cogeco’s request is reasonable in the circumstances.

Accordingly, all interventions in connection with this application are to be filed by
8 August 2012, and Cogeco may file reply comments by 15 August 2012.

In accordance with the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure, if a document is to be filed or served by a specific date, the document must actually be received, not merely sent, by the date indicated.  A document must be filed with the Commission by 5 p.m. Vancouver time (8 p.m. Ottawa time) on the date it is due.  Copies of the documents should also be sent to the following email address: danny.moreau@crtc.gc.ca

In its intervention dated 19 July 2012, TCC noted that Cogeco’s application refers to three letters filed by TCC with the Commission, dated 18 June 2012, 5 July 2012 and 17 July 2012, in the context of the proceedings to implement local competition in the territories of the small ILECs.  As requested by TCC, those letters will be added to the record of this proceeding.
