Dear Mr. Lawford:
In reviewing the four outstanding applications by PIAC for its costs related to its participation in various Commission proceedings, it has come to Commission staff’s attention that the claimants John Lawford and Jean François Léger submitted a Form 1 that is outdated or incomplete. Commission staff notes that Form 1 has been updated to reflect the requirement that legal counsel provide an attestation as to the manner in which they report their employment status to the relevant law society, as set out in paragraph 22 of the Guidelines for the Assessment of Costs (the Guidelines). This new form is available on the Commission’s website at the following address: http://www.tlc.gc.ca/formsapps/getform.asp?formname=crtc43e.htm.
Commission staff also notes that where legal fees are being claimed for Jean François Léger, Mr. Lawford has signed Form 1 on behalf of Mr. Léger. Commission staff notes that Form 1 requires the claimant to sign the form in order to certify that its information is true and accurate.
As a result, Commission staff requests that PIAC file the following information by
15 June 2012:
1. Provide one signed letter from each claimant, attesting as to the manner in which they report their employment status to the relevant law society or alternatively, refile all Form 1s filed by the claimants in these applications using the new form.
2. Refile Form 1 for the legal fees claimed for Mr. Jean François Léger, signed by Mr. Léger, in the cost applications related to PIAC’s participation (in the PIAC Part 1 re certain billing practices and the Bell Part 1 re revised requirement for negotiated agreements), or provide an explanation as to why the form cannot be signed by the claimant and proof that Mr. John Lawford has the authority to sign on Mr. Léger’s behalf.
