RE: Tariff Notice 7323 - High Definition Serial Digital Video Channel Service

On 22 August 2011, the Commission received an application by Bell Canada under Tariff Notice 7323 in which the company proposed changes to its Special Facilities Tariff (SFT) to introduce Item D83 - High Definition Serial Digital Video Channel Service (HD SDI service). The Commission approved Bell Canada’s application on an interim basis, effective 6 September 2011. The application did not receive final approval as the application was held pending the disposition of a Part 1 application filed by TELUS Communications Company (TCC) on 12 August 2011 in relation to Bell Canada’s offering of HD SDI service.

The Commission rendered its decision on TCC’s application in TELUS Communications Company - Application regarding Bell Canada’s high definition serial digital interface local video channel service, Telecom Decision CRTC 2011-800, 21 December 2011. In this decision, the Commission directed Bell Canada to file a general tariff (GT) for HD SDI service with the Commission, and to bring all existing HD SDI service arrangements it offered or provided in its operating territory in compliance with this tariff within 30 days of its approval. Bell Canada and Bell Aliant, respectively, filed applications under Bell Canada TN 7344 and Bell Aliant TN 399 on 26 January 2012. These applications were approved by the Commission on a final basis in Telecom Order CRTC 2012-161, 19 March 2012.

Commission staff notes that the 30 day period for bringing all existing HD SDI service arrangements in compliance with this GT following approval of the GT has now passed. Commission staff requests that Bell Canada confirm in writing that all existing HD SDI service arrangements offered or provided in your operating territories are in compliance with the GT. Commission staff also notes that final approval of SFT Item D83 filed under TN 7323 was held pending resolution of the TCC Part 1 application. Therefore, Commission staff requests that Bell Canada confirm in writing whether it continues to provide service pursuant to SFT Item D83 or whether these arrangements have also been transferred to the GT.

Commission staff requests a response by 20 June 2012.
