Re:   Applications regarding Ethernet Services and related matters – Request for extension and modification of the procedures

On 8 May 2012, Commission staff issued two separate information requests in this proceeding; one to a list of Ethernet service providers and the other to parties in this proceeding. Responses to both of these information requests were to be filed by

18 May 2012.

The Commission is in receipt of a letter from Cogeco Cable Inc. (Cogeco), dated

16 May 2012, requesting a 7-day extension of the filing date to respond to the information request sent to Ethernet service providers. Cogeco submitted that it would be unable to respond to the information requested in interrogatory 101 by 18 May 2012 since the data was not readily available. Cogeco also requested a modification of the procedures of this proceeding such that all the list of Ethernet service providers to whom interrogatory 101 was posed be afforded an opportunity to address interrogatory 202, which was addressed only to the parties in this proceeding.

The Commission received letters from Shaw Cablesystems G.P. and TELUS Communications Company, both dated 16 May 2012, supporting Cogeco’s requests.

With respect to Cogeco’s request to modify the procedures of this proceeding, Ethernet service providers to whom interrogatory 101 was posed, in addition to the parties to this proceeding, can respond to interrogatory 202 if they so chose.  Commission staff also considers that the request for a 7-day extension to the filing date is reasonable.

Accordingly, parties to the proceeding and Ethernet service providers are to file their responses as applicable to the two separate Commission staff information requests with the Commission, serving a copy on all parties to the proceeding and the Ethernet service providers on the attached distribution list, by 25 May 2012.
