RE:  Tariff Notice 881 – Occupancy rates for radio sites

Dear Mr. Yeulett:

On 2 February 2012, the Commission received the above-mentioned tariff notice submitted by Northwestel Inc.  The company indicated that its application was filed as a Group B retail tariff filing under Approval mechanisms for retail and CLEC tariffs, Telecom Regulatory Policy CRTC 2008-74, 21 August 2008.

In Price cap regulation for Northwestel Inc., Telecom Decision CRTC 2007-5, 2 February 2007, the Commission assigned Item 702 – Occupancy at Radio Sites, a co-location service, to the Competitor Services basket. Commission staff therefore considers that this application is not a retail tariff filing but a competitor tariff subject to the approval process for competitor tariffs indicated in Approval processes for tariff applications and intercarrier agreements, Telecom Information Bulletin CRTC 2010-455, 5 July 2010.

For purposes of efficiency, the Commission will process this application as a competitor tariff filing rather than close the file and require the company to refile it as a new application.  Accordingly, interested parties may file interventions within 30 calendar days of the filing date of this application, and the applicant may file reply comments within 10 calendar days of the deadline for filing interventions.  The Commission will issue an order or a decision to dispose of this tariff application.
