Re: Application by the Association des Compagnies de Téléphone du Québec inc. (ACTQ) and the Ontario Telecommunications Association (OTA) to stay certain portions of Telecom Regulatory Policy CRTC 2011-291 and to defer other proceedings
Dear Mr. Désy and Mr. Holmes,
The Commission received a joint submission by the ACTQ and the OTA (collectively, ACTQ/OTA), dated 3 February 2012, on behalf of 30 small incumbent local exchange carriers (small ILECs),1 requesting that the Commission stay, on an urgent and expedited basis, the implementation of certain Commission determinations and directives contained in Telecom Regulatory Policy CRTC 2011-291 (TRP 2011-291).2 ACTQ/OTA requested the stay in light of their petition to the Governor in Council, pursuant to section 12 of the Telecommunications Act, to vary TRP 2011-291.
In addition, ACTQ/OTA requested that the Commission suspend the regulatory framework proceeding initiated by Telecom Notice of Consultation CRTC 2011-348 (TNC 2011-348),3 as well as stay the decisions with respect to the implementation of local competition in the small ILECs’ territories in Quebec and Ontario, until the Governor in Council completes its review.
Commission staff has carefully considered ACTQ/OTA’s request, and considers it appropriate to expedite the comment and reply period for this application. Accordingly, parties may file comments with the Commission and serve such comments on the applicants, by
17 February 2012. The applicants may file reply comments with the Commission, serving copies on all other parties, by 22 February 2012.
The Commission will notify the parties no later than 17 February 2012 as to whether it intends to temporarily delay the proceeding related to the regulatory framework and implementation process for local competition noted above, while the Commission considers this application.
