RE:  Tariff Notice 394 – Special Facilities Tariff - Digital Transmission Facilities

Dear Sir:

On 6 January 2012, the Commission received an application by Bell Aliant Regional Communications, Limited Partnership (Bell Aliant), under cover of Tariff Notice 394 (TN 394), in which the company proposed changes to its Special Facilities Tariff, Item D36 – Digital Transmission Facilities – DS-1.

The company proposed to add a new item, number D36 (ddd), for an unchannelized DS-1 access facility between the customer’s premises in Kirkton, Ontario and Bell Aliant’s nearest central office.

Commission staff notes that on 5 January 2012, the Commission received an application by Bell Aliant, under cover of Tariff Notice 393 (TN 393) in which the company proposed to add a new item number D36 (ddd) to its Special Facilities Tariff for an unchannelized DS-1 access facility between the customer’s premises in Woodstock, Ontario and Bell Aliant’s nearest central office.

Commission staff notes that it appears that there may be an error in TN 394 as the proposed new item is the same item number as the new item proposed in TN 393 yet it has a different description.

Commission staff requests the company file an amendment to TN 394 correcting the item number.  The company may request the same effective date in the amendment application.

As a result of the requirement for an amendment, this application, along with any associated subsequent revisions may not be approved on an interim basis on the 15th calendar day following their receipt.  However, the Commission intends to dispose of this application, along with all associated subsequent revisions, within 45 days of receipt of the filing.
