This is in reference to the application by Cogeco Diffusion Acquisitions Inc. for authority to amend the technical parameters of the radio programming undertaking CHMP-FM Longueuil in order to install a new transmitter that will provide an effective radiated power of 100 kW.
Section 22 of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure provides that an applicant must serve its application on a respondent defined as a person who is “adverse in interest.” The guidelines on the Rules of procedure include a chart of persons generally considered to be respondents (paragraph 61). The list is not exhaustive since parties that can be considered respondents depend on the specific facts of the application.
Please note that, due to the possibility of interference, the licensees of radio stations
CIAX-FM in Windsor, Quebec and CJWL-FM in Ottawa, Ontario, may be “adverse in interest.”
Staff notes that CIAX-FM filed an intervention regarding your application. It appears that the licensee of the station CJWL-FM was not notified of your application.
You are therefore required to serve your application on Ottawa Media Inc. / Evanov Radio Group (CJWL-FM Ottawa, Ontario) by 18 October 2012. Please note that a document is not served until it is received by the recipient. Accordingly, if you serve a person by mail, you are required to send the document in time for it to be delivered no later than 18 October 2012.
Furthermore, as per section 8 of the application form, Respondents, please revise the chart below with the required information as stated in the Rules of Practice and Procedure.
