Re: application number 2012-0355-4. Undue preference/disadvantage complaint from OUTtv Network Inc. (OUTtv) filed on 20 March 2012 against TELUS Communications Inc. (TELUS).

Commission staff has received correspondence from TELUS (dated 9 July 2012) and OUTtv (dated 17 July 2012) in relation to a staff letter dated 3 July 2012 requiring that TELUS file certain information in order to enable the Commission to reach a full and satisfactory understanding of the subject matter of the above-noted complaint.

Commission staff notes that in its letter, OUTtv objects to the confidential treatment – in relation to OUTtv – of certain information submitted by TELUS in its 9 July 2012 letter. As such, OUTtv requests that TELUS be required to disclose to OUTtv the penetration levels for each of its Lifestyle and Lifestyle Extra packages and the passage from paragraph 9 of TELUS’s submission regarding the relevance of its marketing efforts as they relate to these packages. OUTtv further confirms that it will keep information disclosed to it as confidential in accordance with the undertaking given by OUTtv earlier as part of the Commission’s mediation process.

In light of the above, TELUS is to file a response to OUTtv’s submission, serving a copy on OUTtv, by 23 July 2012. Commission staff will inform the parties of any further process steps after that date.
