Dear Mr. Dancy,

Reference is made to your correspondence of 5 and 6 June 2012 wherein you indicate that, due to a real-estate project, the details of which you are unable to disclose, you may not be available to attend the hearing of the application by Radio 710 AM Inc. to renew the license of the undertaking CJRN scheduled to begin on 19 June 2012.  At that hearing Radio 710 AM Inc. will be expected to show cause why the license of CJRN should not be subject to a short term renewal or mandatory orders, or should not have its license suspended, or not renewed.

Radio 710 AM Inc. was notified on 18 April 2012 of the Commission’s decision to call it to a hearing. Your correspondence indicates you have been aware of this real-estate commitment for approximately six months and, therefore, knew about it at the time the hearing was announced.  The Commission considers that you had adequate time to arrange your schedule accordingly.

Despite concerns about the timing of your request, in light of the nature of the application and of the issues that will be discussed at the hearing, the application by Radio 710 AM Inc. will now be heard as the last item on the hearing.  Note that the hearing is currently scheduled for three days and, as such, the application by Radio 710 AM Inc. may be heard in the afternoon of Thursday 21 June 2012.

Responsibilities of Participants

Please note, that participants are responsible for monitoring the progress of the hearing so that they will be aware of any Commission directives and ready to make their presentation on the day scheduled or, if necessary, the day before or after their scheduled date of appearance depending on the progress of the hearing.

It is the responsibility of Radio 710 AM Inc. to ensure that representatives appearing on its behalf are capable of addressing questions related to its undertaking. Should you, Mr. Dancy, not be available, it will be the licensee’s responsibility to find an adequate replacement and appropriate representation. As such, we would ask that, upon receipt of this correspondence, or by
11 June 2012, 10 a.m., you confirm the members of the panel who will appear to represent Radio 710 AM Inc.Should the licensee fail to appear, a decision regarding its application will nonetheless be made on the basis of the existing record.
