Dear Mr. Rudock:
On 17 January 2012, Commission staff requested that you file a self-assessment report pertaining to the musical content broadcast during the week of 8-14 January 2012. This was requested to be filed by 30 January 2012. On 28 March 2012, we received the documents in question; however, as noted in Broadcasting Notice of Consultation CRTC 2012-224-1 (the Notice of Consultation), they were incomplete.
Upon further review of the material you did file, we note that in your self-assessment report, you have reported the following:
- 22% of Canadian content broadcast throughout the broadcast week
- 31% of Canadian content broadcast between 6AM and midnight, Monday to Friday.
Subsections 2.2(8) and 2.2(9) of the Radio Regulations, 1986 (the Regulations) state the following:
2.2(8) Except as otherwise provided under a condition of its licence that refers expressly to this subsection and subject to subsection (6), an A.M. licensee, F.M. licensee or digital radio licensee that is licensed to operate a commercial station, community station or campus stations hall, in a broadcast week, devote at least 35% of its musical selections from content category 2 to Canadian selections broadcast in their entirety.
2.2(9) Except as otherwise provided under a condition of its licence and subject to subsection (6) an A.M. licensee, F.M. licensee that is licensed to operate a commercial station shall, between 6:00 a.m. and 6:00 p.m., in any period beginning on a Monday and ending on the Friday of that week, devote at least 35% of its musical selections from content category 2 to Canadian selections broadcast in their entirety.
The information provided in your self assessment report indicates that you may have failed to comply with these provisions of the Regulations.
Please be advised that, in addition to the completeness of the self-assessment report and the music lists and other matters as noted in the Notice of Consultation, the Commission may also wish to discuss this issue the apparent non-compliance with subsections 2.2(8) and 2.2(9) of the Regulations with you further at the 19 June hearing in Gatineau at which you are expected to appear. Please be prepared to do so. No further comment is necessary until then.
A copy of this letter and all related correspondence will be added to the public record of the proceeding.
