Issues addressed at the Public Hearing

This letter is in response to Mr. Macdonald’s emails sent on 27 April 2012 and 1 May 2012. In the 27 April email, the Commission was informed that Mr. Claassen, the owner of Bluepoint Investments Inc. (Bluepoint) may be unable to attend the public hearing due to a medical emergency. It was also mentioned that Karen Shack, Chief Financial Officer and Joanne McDonald, General Manager of SCN would attend the Public Hearing in the event that Mr. Claassen remains unable to appear. In the 1 May email, the Commission was informed that Mr. Claassen would be able to attend the hearing and fully participate in the consultation.

The Commission wishes to inform you that, amongst others, the following issues will be addressed at the public hearing:

• Integrity of the licensing process;

• Whether the vendor would unreasonably gain from the sale of the regulated asset,
including supporting evidence of the $2.5M invested into SCN’s operations since its acquisition by Bluepoint (Reference: Supplementary Brief, paragraph 48) and how this gain is rationalized relative to the reduced commitments which have been proposed by Rogers; and

• The rationale behind not fulfilling the commitment to spend $1.75M in Independent
Production and $1M in Digital production in Saskatchewan for seven years as
committed to in Broadcasting Decision 2010-965 and information about SCN’s
investments in Independent and Digital production in Saskatchewan.

Responsibilities of Participants

It is Bluepoint’s responsibility to ensure that representatives appearing on its behalf are capable of addressing questions about the issues listed above. As such, we would ask that, upon receipt of this correspondence or by 4 May 2012, 5 p.m., you confirm the members of the panel who will appear to represent Bluepoint by e-mail at hearing@crtc.gc.ca. Upon arrival at the hearing, please confirm these names with the Secretary of the hearing.
