Re: application number 2012-0355-4. Undue preference/disadvantage complaint from OUTtv Network Inc. (OUTtv) and request for disclosure of “confidential” information from TELUS.

On 25 April 2012, OUTtv Network Inc. (OUTtv) requested that certain information designated as “confidential” in TELUS’ answer, submitted on 23 April 2012, be disclosed to OUTtv in order that a complete opportunity to reply to the information could be provided by OUTtv. Specifically, OUTtv requested certain information from paragraphs 11 and 17 regarding packaging and penetration levels of TELUS’ services.

OUTtv’s request is approved in part. Commission staff acknowledges TELUS’ disclosure of some of the requested additional information in confidence to OUTtv in respect of paragraphs 11 and 17, and is satisfied that this information is sufficient for OUTtv to submit a final reply. Accordingly, in light of the “new” information being disclosed, the deadline for OUTtv’s final reply is extended to 7 May 2012.

The correspondence relating to this matter will form part of the record and a copy of this letter will be added to the public record of the proceeding.
