Re: applications number 2012-0439-6 and 2012-0441-1

This is in reference to the applications by Cogeco Diffusion Acquisitions inc. For authority to amend the technical parameter of the radio programming undertakings CHMP-FM Longueuil and CKBE-FM Montréal in order to install new transmitters which can provide an effective radiated power of 100 kW.

Section 22 of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure provides that an applicant must serve its application on a respondent defined as a person who is “adverse in interest”. The guidelines on the Rules of procedure1 include a chart of persons generally considered to be respondents (paragraph 61). The list is not exhaustive since parties that can be considered respondents depend on the specific facts of the application.

We note that you have not served your application on respondents that could be “adverse in interest”.

As noted in section 7.2 of your application, you have identified that the net impact of this frequency change proposal will result in the station’s population coverage increasing significantly in the 3mV/m contour from 3,589,705 to 3,775,125.  Please note, from an economic perspective, the other incumbent radio services in Montréal and Longueuil could also be “adverse in interest.”

You are therefore required to serve the applications noted above on the other incumbent/existing services in Montréal and Longueil, Quebec, by 14 May 2012. Note that a document is not served until it is received by the intended recipient. Therefore, if you are serving a person by mail, you must send it in time for it to be delivered on or before 14 May 2012.

Furthermore, as per section 5 of the application form, Respondents, please revise the chart below with the required information as stated in the Rules of Practice and Procedure.
