Re: application number 2012-0220-0
This is in reference to your application for a technical amendment to a broadcasting licence to transition CFTV-TV Leamington (Southshore Broadcasting Ltd.) from analog television to digital television and to transmit four separate services with the proposed digital transmitter.
Section 22 of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure provides that an applicant must serve its application on a respondent defined as a person who is “adverse in interest.” The guidelines on the Rules of procedure1 include a chart of persons generally considered to be respondents (paragraph 61). The list is not exhaustive since parties that can be considered respondents depend on the specific facts of the application.
We note that you have not served your application on any respondents.
In light of the above, you are therefore required to serve the application by 26 March 2012 on:
- Bell ExpressVu Inc. (the general partner), and Bell Canada and Bell ExpressVu Inc., partners in BCE Holdings G.P. (the limited partner), carrying on business asBell ExpressVu Limited Partnership; and
- Cogeco Cable Canada GP Inc. (the general partner) and Cogeco Cable Canada Inc. (the limited partner), carrying on business asCogeco Cable Canada LP.
Note that a document is not served until it is received by the intended recipient. Therefore, if you are serving a person by mail, you must send it in time for it to be delivered on or before 26 March 2012.
Furthermore, as per section 8 of the application form, Respondents, please revise the chart below with the required information as stated in the Rules of Practice and Procedure.
