Various commercial radio programming undertakings – Licence renewals

1. The Commission renews the broadcasting licences for the radio programming undertakings set out in Appendix 1 to this decision. The expiry dates for these licences are set out in that appendix. These short-term licence renewals1 will allow for an earlier review of the licensees’ compliance with their conditions of licence and the Radio Regulations, 1986 (the Regulations). The licences will be subject to the conditions of licence set out in the appropriate appendices to this decision. The Commission did not receive any interventions in connection with these applications.

Non-compliance

2. In Broadcasting Notice of Consultation 2012-461, the Commission highlighted the various areas with which the licensees set out in Appendix 1 to this decision appeared to be in non-compliance.

3. Upon review of the record, the Commission finds that Pineridge Broadcasting Inc., licensee of CHUC-FM Cobourg, and Quinte Broadcasting Company, licensee of CIGL-FM Belleville, did not fail to comply with section 9(2) of the Regulations relating to the provision of annual returns for the broadcast years specified in Broadcasting Notice of Consultation 2012-461. However, the Commission notes that the aforementioned licensees remain in non-compliance with section 15(2) of the Regulations relating to Canadian content development (CCD) contributions, for the broadcast years listed in that notice.

4. Further, having considered the full record for each application, the Commission finds that, with the exception noted above, the licensees set out in Appendix 1 to this decision are in non-compliance with their regulatory requirements as highlighted in Broadcasting Notice of Consultation 2012-461.

5. Finally, the Commission finds that in addition to the non-compliances set out in Broadcasting Notice of Consultation 2012-461, the following licensees failed to comply with section 15(2) of the Regulations relating to CCD contributions for the broadcast years set out below:

Regulatory measures

6. In Broadcasting Information Bulletin 2011-347, the Commission announced a revised approach to dealing with radio stations found in non-compliance. The Commission noted in particular that each instance of non-compliance will be evaluated in light of factors such as the quantity, recurrence and seriousness of the non-compliance. The Commission also noted that it will consider the circumstances leading to the non-compliance in question, the licensee’s arguments and the measures taken to rectify the situation.

7. In addition to the public record for each application, the Commission has taken into account the factors elaborated in the above-noted information bulletin in determining that the most appropriate measures to deal with these instances of non-compliance are short-term renewals, as set out in Appendix 1 to this decision.

8. In addition, upon review of the record, the Commission finds that a number of licensees have outstanding shortfalls relating to required contributions to Canadian talent development (CTD) or CCD, or have provided insufficient information to support their claims of compliance. Consequently, the Commission has imposed conditions of licence to remedy these shortfalls on a number of licensees.

9. The Commission emphasizes the importance it places on a licensee’s fulfillment of its regulatory obligations. The short-term renewals set out in Appendix 1 will allow for an earlier review of each licensee’s compliance with their conditions of licence and the Regulations.

10. The Commission reminds licensees that they must fulfill all of their remaining contributions to CTD, CCD and any outstanding tangible benefits as set out in a prior Commission decision.

Employment equity

11. Unless otherwise specified, these licensees are subject to the Employment Equity Act and file reports concerning employment equity with the Department of Human Resources and Skills Development. Accordingly, their employment equity practices are not examined by the Commission.

  2. The licensee shall broadcast two hours per week of Cree-language programming.

  2. The licensee shall provide proof of payment demonstrating that the amount of $4,965 was paid to FACTOR relating to the shortfall incurred during the 2009-2010 broadcast year. The licensee shall file the required proof of payment by no later than 8 May 2013.

  2. The licensee shall provide proof of payment demonstrating that the amount of $1,200 was paid to FACTOR in order to demonstrate that all payments for the 2008-2009 and 2009-2010 broadcast years have been made. The licensee shall file the required proof of payment by no later than 8 May 2013.

  1. The licensee shall adhere to the conditions set out in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, 11 February 2009.
  2. The licensee shall provide proof of payment demonstrating that the amount of $115 was paid to FACTOR in order to demonstrate that all payments for the 2008-2009 broadcast year have been made. The licensee shall file the required proof of payment by no later than 8 May 2013.
  3. In addition to the requirements as set out in Section 15 of the Radio Regulations, 1986, the licensee shall contribute $400 per broadcast year to FACTOR.

The licensee shall pay $452 relating to the shortfall incurred during the 2007-2008 broadcast year to an eligible Canadian content development initiative as specified in the eligibility criteria set out in paragraph 108 of Commercial Radio Policy 2006, Broadcasting Public Notice CRTC 2006-158, 15 December 2006 and provide proof of payment of these contributions by no later than 8 May 2013.
  3. The licensee shall pay $658 relating to the shortfall incurred during the 2008-2009 broadcast year to FACTOR and provide proof of payment of these contributions by no later than 8 May 2013.

  3. The licensee shall pay a $480 contribution to FACTOR relating to the shortfalls incurred during the 2008-2009 and 2009-2010 broadcast years and provide proof of payment of these contributions by no later than 8 May 2013.

Appendix 14 to Broadcasting Decision CRTC 2012-703

Terms, conditions of licence and encouragement for the commercial radio programming undertaking CISK-FM Williams Lake, British Columbia

Terms

The licence will expire 31 August 2014.

Conditions of licence

1. The licensee shall adhere to the conditions set out in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, 11 February 2009.

2. The station shall be operated within the Specialty format as defined in A Review of Certain Matters Concerning Radio, Public Notice CRTC 1995-60, 21 April 1995, as amended from time to time.

3. The licensee shall ensure that a minimum of 50% of all musical selections broadcast during each broadcast week shall be devoted to selections drawn from music subcategory 35 (non-classical religious).

4. The licensee shall not broadcast any hit material as defined in Revised Policy on the Use of Hits by English-Language FM Radio Stations, Public Notice CRTC 1997-42, 23 April 1997.

5. The licensee shall not broadcast or solicit commercial messages.

6. During each broadcast week, the licensee shall broadcast, at a minimum, 15 hours of balanced programs, which may include programs of non-classical religious music reflecting a variety of faiths.

7. The licensee shall adhere to the guidelines on ethics in religious programming as set out in section IV of Religious Broadcasting Policy, Public Notice CRTC 1993-78, 3 June 1993, as amended from time to time.

8. During each broadcast week, the licensee shall direct programming to a minimum of two cultural groups, in a minimum of two different languages.

9. The licensee shall pay $1,600 relating to the shortfalls incurred during the 2004-2005, 2005-2006, 2006-2007 and 2007-2008 broadcast years to an eligible Canadian content development initiative as specified in the eligibility criteria set out in paragraph 108 of Commercial Radio Policy 2006, Broadcasting Public Notice CRTC 2006-158, 15 December 2006 and provide proof of payment of these contributions by no later than 8 May 2013.
