RE: Tariff Notice 878 – Withdrawal of Manual Mobile Service

Dear Sir:

The Commission received the above-mentioned tariff notice, dated 2 December 2011, from NorthwesTel. In its application, the company proposed to remove both fixed and non-fixed Manual Mobile Service (MMS) from 24 sites.

Commission staff notes that NorthwesTel has provided notice to customers affected by its application, as required by Approval processes for tariff applications and intercarrier agreements, Telecom Information Bulletin CRTC 2010-455, 5 July 2010 (the bulletin).

NorthwesTel has indicated that the deadline for customers to send comments to NorthwesTel and the Commission is 5 January 2012. However, the bulletin states that interested parties may file interventions within 30 business days of the filing date of an application, and the applicant may file reply comments within 10 business days of the deadline for filing interventions.

In addition, paragraph 95 of the of Guidelines on the CRTC Rules of Practice and Procedure, Broadcasting and Telecom Information Bulletin CRTC 2010-959, 23 December 2011, specifies that applicants should not count Saturdays, Sundays, holidays, or the Holiday Break of 21 December to 7 January when calculating deadlines for filing documents in proceedings for the destandarization or withdrawal of a tariff.

As a result, based on the filing date of NorthwesTel’s application, the deadline for the company’s customers to file comments is 1 February 2012 and the deadline for NorthwesTel to file reply comments is 15 February. NorthwesTel is to send a revised notice to affected customers to clarify the deadline for customer comments.

In addition, NorthwesTel is to ensure that the notice to customers includes a reference to the Tariff Notice number associated with the application and a copy of the proposed amended tariff pages for which approval is sought.
