RE:  Tariff Notice 326 – Call Management Services

Dear Sir:

On 29 November 2011, the Commission received an application by NorthernTel, Limited Partnership (NorthernTel), under cover of Tariff Notice 326, in which the company proposed to increase the rates for Pay-Per-Activation Services and the Residential Call Management Bundle.  The company indicated that its application was filed as a Group A tariff filing.

Commission staff notes that pursuant to Approval processes for tariff applications and intercarrier agreements, Telecom Information Bulletin CRTC 2010-455, 5 July 2010 (Information Bulletin 2010-455), retail tariff filings qualify as Group A filings if the associated revisions are restricted to, among other things, changes to previously approved rates for retail services where the revised rates meet the Commission’s price cap or price regulation rules and the price floor test, as applicable.

Commission staff also notes that, pursuant to Telecom Decision CRTC 2006-14, Revised regulatory framework for the small incumbent local exchange carriers, 29 March 2006, rates for services in the Fourth Basket will be allowed to increase up to any rate approved by the Commission for the same service.

Commission staff considers that NorthernTel’s Residential Call Management Bundle is not similar to Télébec’s bundle as Télébec’s bundle does not include a toll service plan.  For that reason, Commission staff is of the view that NorthernTel’s application does not comply with the Commission requirements pertaining to Group A tariff applications described in Information Bulletin 2010-455.  Accordingly, the company is not to implement these tariff revisions.

NorthernTel may submit a new application addressing the above-mentioned concern.  The application must be presented in the form of a new tariff notice.
