RE:  Tariff Notice 110

Dear Mr. Craig:

On 11 November 2011, the Commission received an application by CityWest Group of Companies (CityWest), under Tariff Notice 109, in which the company proposed to introduce a new residential bundle effective 15 December 2011.

The company indicated that its application was filed as a Group A retail tariff filing under Approval processes for tariff applications and intercarrier agreements, Telecom Information Bulletin CRTC 2010-455, 5 July 2010, as amended from time to time, (Information Bulletin 2010-455).

Commission staff considers that application does not meet the definition of Group A retail tariff filings as indicated in Information Bulletin 2010-4551 as it pertains to the introduction of a new service bundle, which clearly falls under the definition of a Group B filing.

For purposes of efficiency, the Commission will process this application as a Group B retail tariff filing rather than close the file and require the company to refile it as a new application.  Consequently, this application will not be approved on an interim basis on the 15th calendar day after its receipt unless the Commission issues an order indicating otherwise prior to that date.  The Commission intends to dispose of this application within 45 business days.
