RE: Tariff Notice 26 – Revisions to General SILEC Tariff reflecting determinations made in TRP CRTC 2011-291
Dear Sir,
On 27 October 2011, the Commission received an application by Quadro Communications Co-operative Inc. (Quadro Communications) under cover of Tariff Notice 26 (TN 26), in which the company requested approval for rate increases to its residence individual line service pursuant to Obligation to serve and other matters, Telecom Regulatory Policy CRTC 2011-291, (TRP 2011-291), 3 May 2011. The company has indicated that its application is a Group A retail tariff filing.
Commission staff notes that the Commission issued a letter, 29 July 2011, in which it determined that, effective 1 August 2011, the small incumbent local exchange carriers’ (ILECs’) rates for residential primary exchange service (PES) are made interim and will remain so until the Commission makes a determination with respect the application made by Request by l’Association des Compagnies de Téléphone du Québec inc. (ACTQ), the Ontario Telecommunications Association (OTA), and CityWest Telephone Corporation (CityWest) to stay part of Telecom Regulatory Policy 2011-291.
In light of the above, Commission staff has determined that Quadro Communication’s application cannot be treated as a Group A retail filing as the rates may only be granted interim approval at this time. The Commission will process this application as a Group B retail tariff filing. Commission staff notes, that generally, a Group B tariff application will receive interim approval on the 15th calendar day after it is received unless the Commission issues a letter indicating otherwise prior to that date. Commission staff notes that in light of the letter noted above, an order will be issued if and when the Commission grants interim approval of the company’s application.
Consequently, the company is to file without delay, revised tariff pages with an effective date of no earlier than 11 November 2011. The company may request an earlier date when it files its revised tariff pages by way of requesting a date effective the date the Commission may grant interim approval. The company is not to implement its proposed tariff revisions until the date it receives interim approval.
