RE: Tariff Notices 10, 11, 12, 13, and 13/A – Revisions to the Competitive Local Exchange Carrier (CLEC) Access Services Tariff

Dear Mr. Matoga:

Between 5 July 2011 and 12 July 2011, the Commission received applications by ISP Telecom Inc. (ISP Telecom), under cover of Tariff Notices (TNs) 10, 11, 12, 13, and 13/A, in which the company proposed modifications to its CLEC Access Services Tariff to incorporate changes in order to reflect updates to the Commission’s CLEC Model Tariff.

Section 28(1)(a) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure provides that the Commission may request parties to file information, particulars or documents where needed.

The company is requested to provide comprehensive answers, including rationale and any supporting information, to the attached questions within 10 business days of the date of this letter.

ISP Telecom TNs 10, 11, 12, 13, and 13/A – Request for information

1.  Commission staff notes that TNs 10, 11, 12, 13, and 13/A were filed by ISP Telecom to make the appropriate updates to its Access Services Tariff to comply with all updates the Commission has made to its CLEC Model Tariff since November 2008.  These TNs were approved on an interim basis in Telecom Order CRTC 2011-430, 19 July 2011.

Commission staff also notes that, if ISP Telecom was charging rates through cross-reference tariff items for the applicable rates set out in ILEC tariffs, it may have charged rates otherwise than in accordance with its approved tariff between November 2008 and the time TNs 10, 11, 12, 13, and 13/A were approved on an interim basis on 19 July 2011.

Indicate whether the company provided, between November 2008 and 19 July 2011, any telecommunications services at rates that were not in accordance with its approved Access Services Tariff that was in effect prior to the time TNs 10, 11, 12, 13, and 13/A were approved on an interim basis.

If yes, indicate, using the tariff item numbers, which telecommunication services were provided at rates that were not consistent with the above-noted version of the company’s approved Access Services Tariff.  The response should include the dates between which each of these tariff items were provided not in accordance with the company’s approved Access Services Tariff and the associated rates that were charged by the company during that period.
