Re: Tariff Notice 70 – Support Structure Service
Dear Mr. Allard:
On 31 August 2011, the Commission received an application from CoopTel, under cover of Tariff Notice 70, in which the company proposed amendments to its General Tariff to introduce section 5.3 – Support Structure Service. The company identified its application as a Group B retail tariff filing.
Commission staff considers that the CoopTel application is not a Group B retail tariff filing as indicated in Telecom Information Bulletin CRTC 2010-455 published 5 July 2010, Approval processes for tariff applications and intercarrier agreements. In particular, Commission staff considers that the application is not such a filing because the service involved is a service to competitors, not a retail service.
Consequently, this application, along with all associated subsequent revisions, will not be approved on an interim basis on the 15th calendar day of their receipt. However, the Commission intends to dispose of this application, along with any subsequent revisions associated with it, within 45 business days of receipt of the last revision.
Moreover, Commission staff notes that amendments to the tariff pages included in the CoopTel application are necessary to make them consistent with the Commission's determinations. For example:
1) In sections 5.3.1, 5.3.2 and 5.3.3, the proposed conditions of service indicate that, if applicable, the charges are based on CoopTel's hourly rates. However, these conditions of service do not specify CoopTel's hourly rates or refer to rates approved by the Commission.
2) Because section 5.3.4 does not say that the rental rate may be charged to a licensee only once per pole, room is left for different interpretations concerning the application of the rate in question.
