Re: Local competition implementation plans – Request for extension to file responses to the Commission’s request for information

Dear Madam, Sir:

In letters dated 20 May 2011, Bragg Communications Inc., carrying on business as EastLink (EastLink), confirmed its interest in entering the territories of Bruce Telecom, Mornington Communications Co-op Ltd., Tuckersmith Communications Co-operative Ltd., Wightman Telecom Ltd. (Wightman), and Hay Communications (together, the small ILECs) as a competitive local exchange carrier. In response to EastLink’s requests, the small ILECs subsequently filed their local competition implementation plans with the Commission.

In a Commission staff letter dated 11 August 2011, the small ILECs were requested to:  i) respond to a request for information regarding their local competition implementation plans; and ii) file any required tariff notices, with justification for the proposed rates, when they submit their responses to the request for information. The small ILECs were to file their responses and tariff notices by 1 September 2011.

On 26 August 2011, the Commission received a letter from Wightman, on behalf of the small ILECs, requesting an extension to the due date for the responses from 1 September 2011 to 15 September 2011.

In reply, EastLink submitted that it was inappropriate for the small ILECs to request such an extension and that if the Commission decided to grant the small ILECs an extension, the small ILECs should be required to file these responses at the same time they filed their reply comments regarding their implementation plans.

Commission staff acknowledges that the small ILECs may have limited resources and that it could be challenging for them to provide the requested information. However, Commission staff notes that the small ILECs have already had a 30-day extension to file their local competition implementation plans and any required tariff notices. Commission staff also notes that these implementation plans were supposed to contain the majority of the information requested by Commission staff in its 11 August 2011 letter.

On balance, Commission staff considers that it would be appropriate to extend the deadlines for the small ILECs to file their responses to the request for information and the required tariff notices by 7 calendar days.

Consequently, the process set out in the Commission staff letter dated 11 August 2011 is amended as follows:

1) The small ILECs are to file their responses to their requests for information by 8 September 2011.

2) EastLink and any interested person may file an intervention, serving that intervention on the small ILECs, by 15 September 2011; and

3) The small ILECs may file a reply by 22 September 2011.

Commission staff has no intention of granting additional extensions.
