Re: Local competition in small ILEC territories – Request for an extension of the deadlines for filing the information and tariff notices required by the Commission in its letter of 26 July 2011
The Commission has received a letter from the Association des Compagnies de Téléphone du Québec (ACTQ) dated 1 August 2011, requesting that the deadline for filing the information required by the Commission in its letter of 26 July 2011 be moved from 16 August 2011 to 31 August 2011. The ACTQ also notes that small ILECs cannot file the tariffs required by the Commission until they know whether TELUS Communications Company (TCC) still intends to enter the territories of the four ILECs with fewer than 3,000 NAS, or until they know TCC’s specific needs in the event that an entry is intended.
The Commission has also received a letter from Cogeco Cable Inc. (Cogeco) dated 2 August 2011, stating that Cogeco is not opposed to the request for an extension of the deadline for filing information, but is opposed to the request for the extension of the deadline for filing the tariff notices.
Commission staff is granting the ACTQ’s request for an extension. The small ILECs must therefore file the information required by the Commission in its letter of 26 July 2011 by 31 August 2011.
The process set out in the Commission’s letter of 26 July 2011 is amended as follows:
TCC and Cogeco may file comments regarding the small ILECs’ responses to the attached request for information by 7 September 2011; and
The small ILECs may file final responses by 14 September 2011.
As for the request to postpone the deadline for filing the tariff notices, Commission staff notes that Cogeco and TCC will need to have the tariff notices in hand in order to make an informed decision with regard to their possible entry into the territories of the four small ILECs with fewer than 3,000 NAS. Furthermore, Commission staff considers that, since the small ILECs have already filed their implementation plans, they should already know the specific needs of Cogeco and TCC with respect to their entry into their territories.
Accordingly, as indicated in the Commission’s letter of 26 July 2011, the small ILECs must file the required tariff notices, with justification for their proposed rates, when they file their responses to the requests for information made by the Commission in that letter. The notices must therefore be filed by 31 August 2011.
All submissions are to be made in accordance with the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure, SOR/2010-277.
