RE:  Mornington’s local competition implementation plan for EastLink

Dear Madam and Sir :

In a letter dated 20 May 2011, Bragg Communications Inc., carrying on business as EastLink (EastLink), informed the Commission and Mornington Communications Co-operative Limited (Mornington) that it is still interested in entering Mornington’s territory as a competitive local exchange carrier in the exchange of Milverton, Ontario. 

Based on the process established by the Commission, as amended, Mornington was to file its implementation plan and other required information with the Commission, serving a copy to EastLink, by 25 July 2011.  The Commission has received Mornington’s implementation plan, and this plan was posted on the Commission’s website on 26 July 2011.

This letter is sent to remind EastLink and Mornington about the process that was set out in the Commission staff letter of 5 May 2011, which stated that the small ILECs’ updated implementation plans would be treated as applications pursuant to section 22 of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (Rules of Procedure).

In particular, pursuant to the Rules of Procedure, EastLink (the respondent) may file an answer with the Commission and serve that answer on Mornington (the applicant) no later than 25 August 2011.  Any interested person may file an intervention with respect to the application no later than 25 August 2011.  Mornington may file, with the Commission, a reply to any answer or intervention no later than 6 September 2011 and serve that reply on EastLink and the interveners to whom Mornington is responding.
