RE: Tariff Notice 32 – Housekeeping changes
The Commission received the above-mentioned tariff notice from Huron Telecommunications Co-operative Limited (HuronTel), dated 4 July 2011, to reflect determinations made in Obligation to serve and other matters,
Telecom Regulatory Policy CRTC 2011-291, 3 May 2011. The company indicated that its revised tariff was filed as a Group A retail tariff filing under Approval mechanisms for retail and CLEC tariffs, Telecom Decision CRTC 2008-74, 21 August 2008.
Pursuant to Approval processes for tariff applications and intercarrier agreements, Telecom Information Bulletin CRTC 2010-455, 5 July 2010 (Telecom Information Bulletin 2010-455) for each Group A retail tariff filing, the company is required to file both the prevailing and revised tariff pages with the Commission, on or before the effective date of the revised tariff. The company is also required to identify the specific regulatory measure(s) that apply.
Pursuant to CRTC Tariff Regulations (SOR/79-555) (Tariff Regulations), reference marks must be used in tariffs to indicate changes in the rates, charges, or wording of tariffs. The reference marks must be placed in the text of a tariff to indicate as nearly as possible where the actual change in a rate, charges or wording of the tariff occurred.
Commission staff notes that HuronTel (1) did not identify the specific regulatory measure(s) that apply, (2) did not identify the changes in the tariff pages with reference marks, and (3) filed its revised tariff after the effective date indicated on page 1 of its submitted General Tariff Section 50 – Check Page. In addition, the effective date of the submitted tariff changes was not consistent throughout the revised tariff.
Commission staff considers that HuronTel’s revised tariff was not filed in accordance with the requirements set out in Telecom Information Bulletin 2010-455 and in the Tariff Regulations. Therefore, the changes described in this revised tariff have not taken effect and this file is closed.
However, HuronTel may submit a new revised tariff addressing the above-mentioned concerns which must be presented in the form of a new tariff notice.
