Re: Request for extension to file wireless number portability implementation plan

Dear Sir:

In a Commission letter dated 5 May 2011, competitors that had previously expressed interest in providing local service or had requested the implementation of wireless number portability (WNP) in one or more of the small incumbent local exchange carriers’ (ILECs) territories were requested to indicate by 20 May 2011 whether or not they were still interested in expanding their operations to offer local service or obtaining WNP in those small ILEC’s territories.

In a letter dated 20 May 2011, Rogers Communications (Rogers), on behalf of Rogers Wireless operating as a wireless service provider, confirmed that it was still interested in obtaining number portability in CityWest Telephone Corporation’s (CityWest) Prince Rupert exchange.

Commission staff subsequently issued a letter to CityWest, notifying the company that it was to file an implementation plan with the Commission, serving a copy to Rogers, by 24 June 2011.

The Commission has since received a request from CityWest for a 90-day extension to the date for filing its plan. The Commission received no comments regarding this request.

Commission staff acknowledges that CityWest may have limited resources and that it may have been challenging for the company to complete its plans within the required 30-day period. However, staff notes that Rogers first notified CityWest of its intention to compete in April 2009, and CityWest had the opportunity to understand Rogers’ requirements at that time.

On balance, Commission staff considers that it would be appropriate to extend the deadline for CityWest to file its implementation plan by an additional 30 days, beyond the initial 30-day deadline provided to each of these companies – that is, to 25 July 2011. Commission staff has no intention of granting additional extensions.
