RE: Application by L’Association des Compagnies de téléphone du Québec inc. (ACTQ) and the Ontario Telecommunications Association (OTA) for a stay of certain portions of Telecom Regulatory Policy CRTC 2011-291

The Commission is in receipt of a joint application dated 20 June 2011 by the ACTQ and the OTA on behalf of 28 small incumbent local exchange carriers (small ILECs).   Specifically, the ACTQ/OTA requested that the Commission  stay, on an urgent and expedited basis, the implementation of the Commission’s determinations and directives contained in the following portions of Telecom Regulatory Policy CRTC 2011-291 (TRP 2011-291):

In addition, the ACTQ/OTA stated their intention to file a review and vary application of TRP 2011-291 with the Commission by no later than 30 June 2011.

Commission staff notes that the determinations and directives in TRP 2011-291 as set out above relate specifically to the implementation of local competition in the territories of the small ILECs.  The ACTQ member companies filed their local competition implementation plans on 9 June 2011 and the OTA member companies are expected to file their implementation plans on various dates in July 2011.

Commission staff anticipates that under the current process, determinations with respect to small ILECs’ local competition implementation plans will likely not be made before November 2011.

In light of the above and given the ACTQ/OTA’s intention to file a review and vary application very shortly, Commission staff consider it would be more practical and efficient for parties to address the merits of the stay application and the review and vary application at the same time.  It is expected that the Commission will address these applications on an expedited basis by no later than October 2011.

A process letter to deal with these applications will be issued as soon as possible following the filing of the review and vary application.

In the meantime, Commission staff expects that the process established in its letter dated 5 May 2011 to examine the local competition implementation plans of the small ILECs will proceed as set out in that letter.
