Re: Local competition in small ILEC territories

In a letter dated 6 May 2011, TELUS Communications Company (TCC) and Cogeco Cable Inc. (Cogeco) jointly informed the Commission and eight small incumbent local exchange carriers (ILECs) that TCC is still interested in interconnecting with those small ILECs to allow Cogeco to offer local services in their territories as a competitive local exchange carrier (CLEC).

In the process established by the Commission, these small ILECs were required to file with the Commission their implementation plans, in addition to any other relevant information, and serve a copy to TCC and Cogeco no later than 9 June 2011.

The Commission received the eight implementation plans on 9 June 2011, and the documents were posted to the Commission's Web site on 10 June 2011.

This is to remind the parties of the process that was communicated in a letter by Commission staff dated 5 May 2011, which is reproduced in part below:

The small ILECs' updated implementation plans will be treated under the process for Part 22 proceedings as set out in the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (Rules of Procedure).

…Pursuant to the Rules of Procedure, each CLEC … (the respondent) that has requested either local competition … in the applicant’s territory may file an answer with the Commission within 30 days of the date that the application is posted to the Commission’s Web site and serve that answer on the small ILEC (the applicant).  Any interested person may file an intervention with respect to the application within 30 days of the date the application is posted on the Commission’s Web site and serve that intervention on the applicant.  The applicant may file, with the Commission, a reply to any answer or intervention within 10 days after the deadline for intervening in the proceeding and serve that reply on the respondent and the interveners to whom the applicant is responding.
