RE: Tariff Notice 59 – Various tariff items

Dear Sir:

On 3 June 2011, the Commission received the above-mentioned tariff notice submitted by Execulink Telecom Inc. (Execulink). The company indicated that its application was filed as a Group A retail tariff filing under Approval mechanisms for retail and CLEC tariffs, Telecom Decision CRTC 2008-74, 21 August 2008.

Pursuant to Approval processes for tariff applications and intercarrier agreements, Telecom Information Bulletin CRTC 2010-455, 5 July 2010 (Telecom Information Bulletin 2010-455), for each Group A retail tariff filing, the applicant is required to file both the prevailing and revised tariff pages with the Commission, on or before the effective date of the application. Commission staff notes that Execulink only filed its revised tariff pages, and that it proposed an effective date of 16 January 2011, which is prior to the date when the company filed tariff notice 59.

Commission staff considers that Execulink’s application was not filed in accordance with paragraph 3 of the Telecom Information Bulletin 2010-455 and therefore is returning tariff notice 59 to the company. As such, please note that the changes described in this tariff application are not effective.

However, Execulink may submit a new application addressing the above-mentioned concerns. The application must be presented in the form of a new tariff notice.
