RE: TELUS Tariff Notice 410

Dear Mr. Reirson:

On 16 May 2011, the Commission received an application from TELUS Communications Company, proposing revisions to its Special Facilities Tariff, CRTC 21463, for the introduction of a Type 1 customer-specific arrangement under item 231, Customer Specific Message Relay and IP Relay Service.

Subsection 28(1) (a) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure provides that the Commission may request parties to file information, particulars, or documents where needed.

The company is requested to provide comprehensive answers, including rationale and any supporting information, to the attached question by 8 June 2011.

1. Commission staff notes that in Accessibility of telecommunications and broadcasting services, Broadcasting and Telecom Regulatory Policy CRTC 2009-430 (TRP 2009-430), 21 July 2009, the Commission directed all local exchange carriers (LECs), including wireless competitive local exchange carriers (CLECs), and voice over IP providers that are required to provide Teletypewriter Relay to provide Internet Protocol (IP) relay service by 21 July 2010. The Commission allowed these service providers to satisfy the obligation to provide IP relay service by providing the service directly or by outsourcing the provision of the service to a third party.

In a Commission letter dated 25 June 2010, LECs were granted an extension to 31 December 2010. In a Commission staff letter dated 11 January 2011, several LECs were granted additional extensions, as requested, due to ongoing technical issues. In the 11 January 2011 letter, Commission staff indicated that it was expected “that LECs will provide high quality IP relay service as soon as possible and by no later than the dates specified [in the 11 January 2011 letter and a letter dated 22 December 2010], and 30 April 2011 where not otherwise specified.”

Commission staff notes that TELUS Communications Company (TCC) has requested approval of Tariff Notice 410, which proposes revisions to its Special Facilities Tariff (SFT) to introduce a Type 1 customer-specific arrangement for message relay and IP relay services, with an effective date of 30 September 2011.

Commission staff considers that the effective date for this tariff is not consistent with the requirement that all LECs were to provide IP relay service by 30 April 2011.

a) Please identify whether the effective date for this service is being requested by TCC or the customer, and provide reasons for the proposed effective date.

b) If the implementation date for this service is being requested by the customer for whom this SFT was developed, please identify the customer in question.
