Re:  CISC Deposit and Disconnection Code Development Ad Hoc Committee Request for Commission Clarification of Scope of Service Providers and Services to which the Code Should Apply

Dear Mr. Abbott:

The Commission is in receipt of your 9 March 2011 letter, as the Chair of the CISC Deposit and Disconnection Code Development Ad Hoc Committee (the Committee), in which you request direction from the Commission regarding the scope of the Task Identification Form (TIF).

In Telecom Regulatory Policy 2011-46 , the Commission requested that “CISC develop a code for disconnections and deposits for all LECs operating in forborne markets that fulfills the criteria for that code set out in Telecom Regulatory Policy 2009-424 .” In your letter you requested clarification of (a) the service providers and (b) the services to which this draft code should apply, on the basis that the committee was unable to reach agreement on these items.

The Commission confirms that the code should apply (a) to all LECs (local exchange carriers) operating in forborne markets and (b) to the provision of residential primary exchange service (PES).
