RE: Co-location and interconnection tariffs

Dear Mrs. MacDonald:

In a letter dated 26 May 2008, Commission staff informed People's Tel Limited Partnership (People's) that, pursuant to Revised regulatory framework for the small incumbent local exchange carriers, Telecom Decision CRTC 2006-14, 29 March 2006, People’s should make co-location space available to Bell Aliant Regional Communications, Limited Partnership, where space is available, under terms and conditions similar to those established for co-location services for the large incumbent local exchange carriers.  To that end, People’s was required to file co-location tariffs by 16 June 2008.

In People's Tel Limited Partnership ‒ Implementation of local competition with Execulink Telecom Inc., Telecom Decision CRTC 2008-93, 29 September 2008, the Commission approved People's implementation plan for local competition with Execulink Telecom Inc.  In that Decision, the Commission also approved People’s proposed services and networks components for local competition and directed the company to file its required tariffs within 30 days of the date of the decision.

Commission staff notes that, to date, the Commission has not received any tariff applications from People’s for the introduction of either the services referred to in Decision 2008-93 or the co-location services referred to in the 26 May 2008 Commission staff letter.

Commission staff reminds People’s that, in light of subsection 25(1) of the Telecommunications Act (the Act), no Canadian carrier shall provide a telecommunications service except in accordance with a tariff filed with and approved by the Commission.

People’s is required to file, by 31 March 2010, tariff applications for the introduction of the services referred to in Decision 2008-93 and the co-location services referred to in the 26 May 2008 Commission staff letter.
