Re: Revision to the treatment of imbalance traffic compensation
In Bell Aliant Regional Communications, Limited Partnership and Bell Canada – Proposed revision to the treatment of imbalance traffic compensation, Telecom Decision CRTC 2010-787, 25 October 2010 (Telecom Decision 2010-787), the Commission determined that competitive local exchange carriers (CLECs) that primarily provide dial-up Internet and two-stage long distance calling services create significantly different traffic patterns than were originally expected when the interconnection compensation rules were established since they do not permit local exchange carriers to reach a balanced or nearly balanced exchange traffic. Accordingly, the Commission considered it appropriate to revise the compensation regime to address the situation.
In that Decision, the Commission directed Bell Canada and Bell Aliant Regional Communications, Limited Partnership (the Bell companies) and all CLECs providing service in the Bell companies’ operating territories to issue revised tariff pages within 30 days of the date of the decision to reflect its determinations. The Bell companies issued their revised tariff pages on 24 November 2010 and these tariffs came into effect on 24 December 2010.
Commission staff notes that, pursuant to Telecom Decision 2010-787, for the traffic flowing between the Bell companies and CLECs in the Bell companies’ operating territories, the compensation payable when the traffic volume is unbalanced is to be reduced[1] (the revised traffic imbalance compensation) when a local exchange carrier (LEC) meets the following criteria:
- the volume of traffic in one direction is more than 80 percent of the total traffic exchanged; and
- the total volume of traffic exchanged is at least 10 million minutes per month.
Commission staff also notes that the revised traffic imbalance compensation applies after a LEC has had an imbalance that meets the above criteria for three consecutive months or more.
In addition, Commission staff notes that the revised traffic imbalance compensation amounts set out in Telecom Decision 2010-787 are to apply equally to any LEC operating in the Bell companies’ operating territories if it has met the above-mentioned criteria three consecutive months prior to the effective date of the tariff. In the case of the Bell companies, since the effective date of the tariff is 24 December 2010, the revised traffic imbalance compensation amounts would have been applicable effective on that date if the LEC met the above criteria for three consecutive months prior to that date.

[1] Specifically, the compensation payable is to be cumulatively reduced by
- 5 percent, for every 2 percent increment, when the volume of traffic in one direction is more than 80 percent to less than or equal to 90 percent, and
- 10 percent, for every 2 percent increment, when the volume of traffic in one direction is more than 90 percent to less than or equal to 100 percent.
