Re:  Part VII Application from Globility Communications Corporation regarding competitor access to the competitive digital networks services of the incumbent local exchange carriers

The Commission is in receipt of the above noted Part VII application from Globility Communications Corporation (Globility), dated 24 December 2010.  As part of its application, Globility requested that the Commission postpone the 3 March 2011 date for implementation of forbearance of certain Competitor Digital Network (CDN) services until Globility’s request has been disposed of, and certain tariffs for interconnecting carrier to interconnecting carrier (IC to IC) links are filed, approved, and implemented.

Commission staff notes that forbearance of the CDN services in question was approved almost three years ago in Telecom Decision 2008-17 and that Globility’s application was not filed until two months prior to that forbearance coming into force, even though Globility was aware, in 2009, of the situation in the Asquith CO which it raises in its application. Accordingly, the forbearance of the CDN services in question is to take place pursuant to the schedule approved in Telecom Decision 2008-17.

However, Commission staff expects the ILECs involved and Globility to work co-operatively to ensure the continued provision of end-to-end service to Globility, pending the outcome of the Globility application.

The Commission is also in receipt of correspondence from MTS Allstream Inc. (MTS Allstream) dated 6 January 2011, requesting an extension until 4 February to file its comments with respect to the Globility Communications Corporation Part VII application noted above.  MTS Allstream indicated that an extension was appropriate because the application date of 24 December 2010 coincided with the beginning of the holiday period, and that it and other parties did not become aware of the application until 4 January 2011 when returning to work after the holidays.

Commission staff considers that, under the circumstances, an extension to the period for comments is acceptable.  Accordingly, the date for comments by interested parties is extended to 31 January 2011, with any reply comments by Globility due on 10 February 2011.
