Re: Follow up to Telecom Regulatory Policy CRTC 2010-632, Wholesale high-speed access services proceeding – Review of proposed tariffs

In accordance with Telecom Regulatory Policy CRTC 2010-632, Bell Aliant Inc.,
Bell Canada, MTS Allstream Inc., Saskatchewan Telecommunications and TELUS Communications Company, collectively the incumbent local exchange carriers (ILECs), and Shaw Communications Inc., Quebecor Media Inc. on behalf of its affiliate Videotron Ltd., Rogers Communications, and Cogeco Cable Inc., collectively the cable carriers filed proposed tariffs with supporting Phase II cost studies that reflect the Commission’s determinations regarding speed matching for aggregate ADSL access service and Third Party Internet Access (TPIA) service. The ILECs and the cable carriers also filed responses to the Commission staff’s 15 September 2010 interrogatories.

In a letter dated 7 January 2011, Vaxination Informatique requested an extension of the deadline for filing comments.  This request was supported by Canadian Association of Internet Providers (CAIP).  Although an extension has not been granted, as noted below, all parties will have an opportunity to file comments on any matter within the scope of this proceeding by 8 April 2011.

In a letter dated 10 January 2011, Canadian Network Operators Consortium Inc. (CNOC) requested among other things that the Commission direct the ILECs and cable carriers to provide further costing information, disclose certain information on the public record, and expedite interim approval of those wholesale services that feature new speeds.  Also in a letter dated 10 January 2011, Primus Telecommunications Canada Inc. indicated that additional costing information is required to allow a fulsome review of the cost inclusions by Bell Canada and Bell Aliant Inc. related to new wholesale systems and processes. Procedural steps to deal with these concerns are identified below.

Commission staff notes that the matter of setting interim rates for new wholesale service speeds will be dealt with after the Commission has received the 20 January 2011 reply comments, as noted below.

Commission staff also notes that it issued interrogatories to ILECs to seek preliminary costing information regarding the proposed cost submissions on 4 January 2011 and that the ILECs were requested to provide written responses to the interrogatories by 17 January 2011. The remaining process for reviewing the proposed tariffs is set out as follows:

Reply comments may be filed by ILECs and cable carriers by 20 January 2011.

Commission staff and the parties may address interrogatories to the ILECs and cable carriers regarding their proposed tariffs, cost studies and both sets of the above-noted interrogatory responses.  Any such interrogatories must be filed with the Commission and served on the respective ILECs and cable carriers by 4 February 2011.

The ILECs and cable carriers are to provide written responses to the interrogatories by 25 February 2011.

Requests by parties for further responses to their interrogatories, specifying in each case why a further response is both relevant and necessary, and requests for public disclosure of information for which confidentiality has been claimed, setting out in each case the reasons for disclosure, must be filed with the Commission and served on the respective ILECs and cable carriers by 4 March 2011 using the Microsoft Excel templates provided in the Attachment to this letter.

Written responses to requests for further responses to interrogatories and for public disclosure must be filed with the Commission and served on the party or parties making the request by 11 March 2011 using the Microsoft Excel templates provided in the Attachment to this letter.

Determinations will be issued regarding requests for further information and public disclosure as soon as possible.  Any information to be provided pursuant to such determinations must be filed with the Commission and served on all interested parties by 25 March 2011.

All parties may file written comments with the Commission on any matter within the scope of this proceeding, serving copies on all other parties, by 8 April 2011.

The ILECs and cable carriers may file reply comments with the Commission, serving copies on all other parties, by 19 April 2011.

Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.  Copies of the documents should also be sent to richard.page@crtc.gc.ca and tom.vilmansen@crtc.gc.ca.
