Subject : Quebecor Media Inc.’s further request for permission to file additional information on the public record of CRTC Notice of Consultation 2011-525
Mr. Péladeau,
This letter disposes of Quebecor Media inc.’s (Quebecor) request, dated 14 November 2011, to be granted permission to file on the public record its response dated 13 October 2011.
Quebecor stated that it is imperative, in light of the public interest and procedural fairness, that its response be added on the public record before the beginning of the hearing. Quebecor noted that Astral included new information (both financial data and an interpretation of this data) in its reply and submitted that Quebecor should have the opportunity to reply to the new information.
The Commission notes that Astral used financial data in response to an argument made in Quebecor’s intervention concerning Astral’s profitability. This data is public and accessible to all parties, who may interpret it as they see fit. In the end, the Commission will be responsible for deciding whether the financial data submitted by Astral is relevant and whether Astral’s interpretation of this data is valid.
The Commission notes that it has already expressed its views with respect to the public interest and procedural fairness in its letter to Quebecor dated 19 October 2011. The Commission remains of the view that Quebecor will have a full opportunity to present its additional arguments and concerns at the hearing. The Commission therefore denies Quebecor’s request to file its additional response on the public record of CRTC Notice of Consultation 2011-525.
