Dear Mr. McBride,
This is in reference to your application for a technical amendment to the following analog radio programming undertaking in British Columbia, CKPM-FM Port Moody.
- Respondents
Section 22 of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure provides that an applicant must serve its application on a respondent defined as a person who is “adverse in interest.” The guidelines on the Rules of procedure1 include a chart of persons generally considered to be respondents (paragraph 61). The list is not exhaustive since parties that can be considered respondents depend on the specific facts of the application.
We note that you have not served your application on any respondents.
As noted in section 7.2 of your application, you have identified that this technical amendment will result in the station’s population coverage increasing in the 3mV/m contour from 119,794 to 156,103, and in the 0.5mV/m contour from 284,432 to 563,525. Please note, the other incumbent radio services that service Port Moody could also be “adverse in interest.”
In light of the above, you are therefore required to serve the application on the other incumbent/existing services that service Port Moody, including other Vancouver area incumbent/existing services that also service Port Moody, by 24 October 2011. Note that a document is not served until it is received by the intended recipient. Therefore, if you are serving a person by mail, you must send it in time for it to be delivered on or before 24 October 2011.
Furthermore, as per section 8 of the application form, Respondents, please revise the chart below with the required information as stated in the Rules of Practice and Procedure.
