Re: Letter from Mr. Hyman Glustein regarding requests for electronic copies of application
This is further to a letter dated July 22 2011, in which Mr. Hyman Glustein notified the Commission of the apparent “failure to make the application (2011-0816-8) for Gospel Media Communications publicly available after three requests” on his part.
As of April 1st 2011, the CRTC Rules of Practice and Procedure (the Rules of Procedure) apply to all proceedings before the Commission including public hearings. Under section 22(2) (b) of these Rules of Procedure, all applicants must file a “website address or, if the application is not posted on their website, the email address where an electronic copy of the application may be requested”.
Applicants must ensure that all applications submitted are made available to the public upon request until the deadline for interventions of the proceeding has ended which in the present case is 15 August 2011.
Where exceptional circumstances have occurred, the Commission has allowed for alternative filing arrangements to be made for filing of documents. The Commission does take note of all other arrangements taken as alternatives to make the above noted application available electronically through the CRTC website or by other means (e.g. fax). However, in light of the new Rules of Procedure, the Commission asks that you reply directly to Mr. Glustein’s letter with the reasons that clearly demonstrate why you believe you deserve an exemption to the Rules of Procedure and therefore cannot provide the copy of the application electronically.
Your response must be filed with the Commission and delivered to Mr. Glustein by no later than 29 July 2011. A copy of this letter and all related correspondence will be added to the public record of the proceeding
