Licence amendments

The Commission approves applications by the Canadian Broadcasting Corporation to amend the broadcasting licences of the television stations listed in this decision in order to change their status from protected stations to low-power unprotected stations.

The applications

1.      The Commission received applications by the Canadian Broadcasting Corporation (CBC) to amend the broadcasting licences of certain television programming undertakings in order to change their status from protected undertakings to low-power unprotected undertakings. The television programming undertakings that are the subject of the applications are as follows:

2.      The CBC submitted that its limited resources do not allow it to convert these stations to digital and that the proposed changes are the best solution for preserving access to the stations that are the subject of the applications. In addition, the CBC indicated that households that will no longer be able to receive these stations’ signals because of their change in status will be eligible for Shaw’s local television satellite solution.[1]

3.      The Commission received interventions regarding the application for CBLN-TV-3 Chatham. The interveners proposed alternatives to the licensee for making a digital service available. The licensee did not reply to these interventions. The public record for this proceeding is available on the Commission’s website at www.crtc.gc.ca under “Public Proceedings.”   

Commission’s analysis and determinations

4.      The Commission notes that the stations that are the subject of this decision are outside the mandatory markets, as established in Broadcasting Regulatory Policy 2010-167. In that policy, the Commission indicated that it did not intend to renew beyond 31 August 2011 authorizations for full-power analog transmitters on channels 52 to 69 outside the markets mandated for conversion.

5.      In this case, the Commission notes that the CBC, out of a desire to preserve access to its services, is applying for a licence amendment in order to change the status of the affected stations to low-power unprotected stations.

6.      The Commission considers that the CBC’s proposal offers a reasonable alternative in order to continue offering over-the-air services to a larger number of Canadian television viewers in the affected communities.

7.      Accordingly, the Commission approves the Canadian Broadcasting Corporation’s applications to amend the broadcasting licences of the television programming undertakings listed in the table below. The technical parameters of these low-power undertakings, which are also set out in the table, are those approved by the Department of Industry (the Department).

8.      Since the technical parameters approved in this decision are for low-power unprotected television services, the Commission reminds the applicant that it will have to choose another channel if ever the Department so requires.

9.      The Commission also reminds the applicant that, pursuant to section 22(1) of the Broadcasting Act, the amendments will be effective only when the Department notifies the Commission that its technical requirements have been met and that broadcasting certificates will be issued.
