La Compagnie de Téléphone de Lambton Inc. – Modifications to direct connection service

1.         The Commission received an application from La Compagnie de Téléphone de Lambton Inc. (Lambton), dated 19 April 2011 and amended on 2 June 2011, in which the company proposed modifications to its General Tariff item 5.4 – Direct Toll (DT), Direct Connection (DC), and Trunking Rates.

2.         Specifically, the company proposed to increase its DC service rate from $0.0132 to $0.0178 per conversation minute. Lambton submitted that, in accordance with Telecom Decision 2005-3, it has been billing Bell Canada at the $0.0178 rate since 1 January 2011 because the annual volume of conversation minutes has decreased to less than 5 million minutes since that date. Lambton therefore requested that the Commission ratify the rate of $0.0178 for the period between 1 January 2011 and the effective date of this rate.

3.         In Telecom Order 2011-383, the Commission approved Lambton’s application on an interim basis, effective 17 June 2011. In that order, the Commission noted that it would address the ratification request and any other related issues in a subsequent order.

4.         The Commission received no comments regarding this application. The public record of this proceeding is available on the Commission’s website at www.crtc.gc.ca under “Public Proceedings” or by using the file numbers provided above.

5.         With respect to Lambton’s ratification request, the Commission notes that, pursuant to subsection 25(4) of the Telecommunications Act, it may ratify the charging of a rate by a Canadian carrier otherwise than in accordance with a tariff approved by the Commission if it is satisfied that the rate was charged because of a circumstance that warrants the ratification.

6.         The Commission notes that Lambton has been billing Bell Canada at the $0.0178 rate since 1 January 2011, that this rate is consistent with the rates set out in Telecom Decision 2005-3, and that Bell Canada did not object to Lambton’s application. For these reasons, the Commission considers that the circumstances warrant the ratification of the charging of the $0.0178 rate for the period requested by Lambton.

7.         In light of the above, the Commission approves on a final basis Lambton’s application and ratifies the charging of the $0.0178 rate for the period between 1 January and 17 June 2011.
