Re: TCC Tariff Notice 551

Ms. Duguay:

On 1 November 2010, the Commission received an application from the TELUS Communications Company (TCC) under cover of Tariff Notice 551, in which the company proposed an amendment to General Tariff CRTC 25080, section 5.01 – Digital Network Services to amend the terms and conditions of its ProxiRéseau service to destandardize it.

The company indicated that the application qualified as a Group B retail filing pursuant to Approval mechanism for retail and CLEC tariffs, Telecom Decision CRTC 2008-74, 21 August 2008 (Decision 2008-74).

Commission staff notes that the application does not meet the definition of Group B filings as Decision 2008-74 specifies that Group B filings will consist of those retail tariff filings that do not belong to Group A and are not associated with service destandardizations or withdrawal. Accordingly, the application will not receive interim approval on the 15th calendar day of its receipt.

The application will be processed in accordance with the procedures and timelines established in Mandatory customer contract renewal notification and requirements for service destandardization/withdrawal, Telecom Decision CRTC 2008-22, 6 March 2008 (Decision 2008-22).

An interrogatory regarding this tariff notice is also attached. In accordance with the procedures and timelines set out in Decision 2008-22, the company is required to file its response to the interrogatory within 10 business days of the date of this letter.

TELUS Communications Company TN 551 Interrogatory

In its Tariff Notice, the company states that current clients of its ProxiRéseau service may keep the service until the end of their contract, at which time they will be moved to the Inter-exchange Digital Private Line Services described in item 5.01.14, section 5 – Digital Network Services, General Tariff 25080.

1) The staff notes that the ProxiRéseau service tariff, described in item 5.01.01, section 5 – Digital Network Services, General Tariff 25080, sets out monthly fees for clients who do not have a contract with the company for these services.

a. Indicate whether there are clients of the ProxiRéseau service who receive the service without a contractual agreement with the company.

b. If so, indicate how the company intends to proceed with these clients once the service has been destandardized.

2) The company is also required to provide an assessment of the impact that the proposed transition would have on each of the 24 clients of the ProxiRéseau service. Specifically, the assessment shall reflect the differences in rates, terms and conditions (such as available speeds) and service charges under the current contracts of ProxiRéseau clients and the contracts that would be proposed following the transition to Inter-exchange Digital Private Line Services.
