Re: Part VII application by Globalive Wireless Management Corp. - Seamless transition when moving out of zone

On 12 October 2010, Globalive Wireless Management Corp. (Globalive) filed a Part VII application requesting that the Commission find that Rogers Wireless Partnership (Rogers) is conferring an undue preference upon itself and direct Rogers to provide seamless transition, between Rogers’ and Globalive’s networks, of voice and data calls.

Globalive also requested an abbreviated process requiring Rogers’ answer to be filed in 10 days from the date of the application and Globalive’s reply to be filed within 5 days thereafter.

Rogers filed a letter on 14 October 2010 strongly objecting to Globalive’s request for an abbreviated process.  Rogers noted that the issues raised by Globalive are complex and requires the gathering of factual evidence that necessitates the normal comment period of 30 days.

Commission staff notes that the application does raise matters that require Rogers to be given adequate opportunity to respond.  Accordingly, Rogers is to file its answer with the Commission, serving a copy on Globalive by 12 November 2010 and Globalive is to file its reply with the Commission, serving a copy on Rogers by 22 November 2010.

Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.
