Re:  Follow-up to Policy 2009-34 – Line-Sharing Service

In Telecom Regulatory Policy CRTC 2009-34 (Regulatory Policy 2009-34) the Commission, amongst other matters, confirmed that the wholesale central-office-based (CO) line-sharing service (Line-Sharing service) provided by the incumbent local exchange carriers (ILECs) would continue to be classified as conditional essential, consistent with Telecom Decision CRTC 2008-17.

Following the release of Regulatory Policy 2009-34, and further to Commission staff letters dated 20 February 2009 and 22 May 2009, the ILECs filed for Commission approval revised tariff pages for their respective Line-Sharing services.

On 13 November 2009, a Commission staff letter was issued suspending consideration of the Line-Sharing service proceeding pending the Commission’s determinations in Telecom Notice of Consultation CRTC 2009-261 (NoC 2009-261).  This suspension resulted from a view that the determinations reached in NoC 2009-261 could impact the forecast demand for the proposed Line-Sharing services.

On 30 August 2010, the Commission issued Telecom Regulatory Policy 2010-632 that dealt with the matters raised in NoC 2009-261.  In that Regulatory Policy, the Commission determined that there would be no requirement to mandate the provisioning of wholesale CO-based ADSL access services.  Commission staff therefore considers that the demand, costs, and rates proposed by each ILEC for their respective Line-Sharing services submitted in the proceeding do not need to be updated.  Accordingly, Commission staff sets out the following process to conclude the Line-Sharing service proceeding:

a) Bell Aliant Regional Communications, Limited Partnership (Bell Aliant) and Bell Canada are to place their annual demand estimates on the public record, consistent with paragraph 3-83 of the ILECs’ regulatory economic studies manual, by 7 September 2010.

b) Bell Aliant is to place its entire response to interrogatory Bell Aliant(CRTC)30Jul09-4 TN 353 on the public record by 7 September 2010.

c) Parties may file further comments by 24 September 2010, serving a copy on all entities set out in the attached distribution list.

d) Parties may file final reply comments by 8 October 2010, serving a copy on all entities set out in the attached distribution list.

Submissions must be actually received, not merely filed and served by the dates indicated.
