Parties to Telecom Notice of Consultation CRTC 2009-432

Re: Proceeding initiated by Telecom Notice of Consultation CRTC 2009-432, Call for comments – Review of the large incumbent local exchange carriers' support structure service rates
As a result of an application made by TELUS Communications Company (TCC), dated
30 October 2008, which requested that the Commission review the rates, terms, and conditions of the support structure service tariffs of the major incumbent local exchange carriers, the Commission issued Telecom Notice of Consultation CRTC 2009-432 to initiate a proceeding in relation to TCC’s requests.
In Service standards for the disposition of telecommunications applications, Telecom Circular CRTC 2006-11, 7 December 2006, the Commission stated that it would categorize Part VII applications into two types: Type 1 applications that generally do not involve multiple parties or raise significant policy issues and Type 2 applications that do involve multiple parties and/or raise significant policy issues.
The Commission also adopted the following service standards for Part VII applications:
- Type 1 Part VII applications – 90 percent of determinations to be issued on an interim or final basis within 4 months of the close-of-record; and
- Type 2 Part VII applications – 85 percent of determinations to be issued on an interim or final basis within 8 months of the close-of-record.
The Commission stated that it would inform applicants by letter, within 10 days of the close of record date, whether the proceeding is considered to be a Type 1 or Type 2 application, and of the applicable service standard.
By letter dated 5 August 2010, Bragg Communications Inc., the Canadian Cable Systems Alliance, Cogeco Cable Inc., Rogers Communications Inc., Shaw Communications Inc. and
Quebecor Media Inc., on behalf of its affiliate Videotron (collectively, the “Cable Carriers”) submitted that Bell Aliant Regional Communications, Limited Partnership, Bell Canada and Télébec Société en commandite (collectively, the Companies) and TCC filed new evidence in their reply comments.
By letter dated 6 August 2010, the Companies replied to the Cable Carrier's letter arguing that it had been submitted out of process, that it was incorrect, and requested the Commission to either (i) strike from the record both the Cable Carriers' out of process letter and the Companies' reply or (ii) make a ruling that both letters be placed on the record of this proceeding.
TCC did not reply to the Cable Carriers’ letter.
Commission staff has decided to place both letters on the record of this proceeding and considers the 6 August 2010 as the close of record date.
Commission staff has assessed the above application and resulting proceeding and considers it to be a Type 2 matter. Accordingly, the Commission expects to issue a determination within 8 months of the close of record.
